DMCA COPYRIGHT INFRINGEMENT POLICY

  1. Purpose and Scope

 

Purpose: Jason Mitchell Group (“JMG”) is committed to respecting the intellectual property rights of others and maintaining a platform free from infringing content. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, JMG has designated a Copyright Agent to receive notifications of alleged copyright infringement. This policy outlines the procedures for submitting such notices and affirms our commitment to promptly addressing and resolving reported claims.

 

Scope: This policy applies to all websites and online platforms owned or operated by JMG, including, but not limited to https://thejasonmitchellgroup.com, its agent subdomains, and any affiliated portals or backend systems.

  1. Procedure for Reporting Copyright Infringement

Pursuant to the DMCA, if you believe that your copyrighted work has been unlawfully infringed on JMG’s website or associated services, you may submit a written notice of infringement containing the following information to our Designated Agent:

  1. Identification of the copyrighted work allegedly infringed, including sufficient detail to enable us to identify the work, such as a description of the work or a URL linking to it.
  2. Identification of the infringing material, including its location (e.g., URL, specific page, or file name) on JMG’s platform that is claimed to infringe your rights.
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement of good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
  6. A physical or electronic signature of the copyright owner or an authorized representative.

Please note that failure to include all required information (e.g., incomplete notices) may result in a delay in the processing or rejection of your claim.

  1. Counter-Notification Procedure

If you believe your content was removed or disabled in error by mistake or misidentification, you may submit a counter-notification to our Designated Agent. Your counter-notification must include:

  1. Identification of the material that was removed and the location where it previously appeared on the website.
  2. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, phone number, and a statement that you consent to the jurisdiction of the federal district court for your judicial district (or for Maricopa County, AZ, if outside the U.S.) and that you will accept service of process from the person who provided the original notification.
  4. Your physical or electronic signature.

Upon receiving a valid counter-notification, JMG may restore the material within 10 to 14 business days unless the original complainant initiates legal action. See Digital Millennium Copyright Act, 17 U.S.C. § 512(g) (2025).

 

  1. Repeat Infringer Policy

JMG has a policy of terminating the accounts of repeat infringers in appropriate circumstances.

  1. Legal Compliance and Enforcement

JMG will review all notices received and, where appropriate, remove or disable access to the affirmed infringing material expediently. We may also notify the alleged infringer of the claim and cooperate with copyright owners and law enforcement authorities in resolution.

JMG reserves the right to reject any claims that, in our judgment, are invalid, incomplete, inaccurate, or otherwise not compliant with the DMCA. We also reserve the right to dispute any claim we believe to be mistaken or unjustified.
